13. TCPA Compliance Statement
Carlink is committed to supporting our customers’ compliance with the Telephone Consumer Protection Act (TCPA) and other applicable telemarketing regulations. By using our platform, you (the Customer) acknowledge and agree to the following:
- 13.1. Customer-Supplied Phone Numbers: All recipient phone numbers are provided solely by the Customer. Carlink does not supply, sell, lease, or otherwise provide phone numbers.
- 13.2. Customer-Initiated Campaigns: All campaigns, including call content, timing, and frequency, are managed exclusively by the Customer. Carlink does not auto-schedule or initiate calls.
- 13.3. Platform and Tools Only: Carlink provides tools and UI to enable Customers to control and execute their campaigns.
- 13.4. Call Recording: Calls may be recorded strictly for quality assurance and operational integrity. Carlink does not monitor or analyze call content.
- 13.5. Customer Responsibility: The Customer certifies that it has obtained all necessary prior express consents required under the TCPA and applicable law.
- 13.6. Content Control: The Customer has full control over the content of calls and AI interactions. Carlink does not draft or approve scripts.
- 13.7. Do-Not-Call & Opt-Out Management: Carlink integrates VoIP systems that scrub against internal Do-Not-Call lists and manage opt-out requests.
- 13.8. Indemnification: The Customer agrees to indemnify and hold Carlink harmless against any claims, damages, or fines arising from violations of TCPA or other applicable laws.
